This Terms of Service covers the Closed Alpha service provided by Health Data Avatar. It explains the requirements we ask of our users when they use our service.

Welcome to Health Data Avatar ("HDA", "we", "our", or "us"). These Terms of Service (“Terms”) govern your access to and use of our web platform and services (the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Service.

Who We Are

Health Data Avatar Ltd. is a UK registered company.

Definitions

  • "User", "you", "your" – refers to any person or entity using the Service.
  • "User Content" – refers to any data uploaded to the Service.
  • "Service" – the software, tools, and interfaces provided by HDA to upload, process, and retrieve health-related data.
  • "Output" – refers to results generated by AI tools within the platform.

Eligibility

To use the Service, you must:

  • Be at least 16 years old;
  • Have legal capacity to enter into these Terms;

Your Account

You are responsible for:

  • Providing accurate information during registration;
  • Maintaining the security of your account credentials;
  • All activity that occurs under your account.

Our Services

The HDA platform allows users to:

  • Upload and store personal and medical documents;
  • Analyse uploaded content using AI to extract structured data or insights;

Important: HDA does not provide diagnostic or treatment services. All information should be checked against the original sources.

User Responsibilities

You agree:

  • Not to upload any content unless you have full legal rights to do so;
  • Not to use the Service in any unlawful, misleading, or harmful way;
  • Not to attempt to reverse-engineer or disrupt the platform.

Privacy

Our Privacy Policy explains how we collect, use, and store your personal data, including any health information you provide.

Intellectual Property

  • We retain all rights in the HDA platform, including all software, branding, and intellectual property.
  • You retain ownership of all User Content you upload.

AI Usage and Outputs

Our Service uses AI to generate content relating to user-uploaded data. You understand and agree:

  • AI-generated content may be inaccurate, incomplete, or outdated;
  • Outputs are provided “as is” and should not be relied upon for clinical decision-making;

Termination

We may suspend or terminate your access if:

  • You breach these Terms;
  • We are required to do so by law;
  • We detect unusual activity on your account;
  • Your conduct creates a risk to other users or to our systems.

You may delete your account at any time. Upon termination, your access to uploaded content and outputs may be restricted or deleted in accordance with our privacy policy.

We reserve the right to temporarily limit or suspend certain features of your account if we detect unusual, suspicious, or potentially harmful activity. This may include, but is not limited to:

  • Excessive usage inconsistent with normal use patterns;
  • Automated access or scraping;
  • Attempts to bypass security or usage restrictions;
  • Suspected compromise of your account credentials.

We will make reasonable efforts to notify you where appropriate, and to restore full access once the issue is resolved. If we believe your account has been compromised, we may require additional verification steps before reactivation.

Modifications

We may update these Terms at any time. If we make material changes, we will provide reasonable notice, such as via email or platform banner.

Your continued use of the Service after changes take effect constitutes your acceptance.

Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee:

  • Availability or uninterrupted access;
  • Accuracy or reliability of outputs;
  • Fitness for a particular purpose.

We disclaim all implied warranties to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Limited Alpha

We are grateful to all early users participating in the Limited Alpha of HDA.

By using the Service during this phase, you acknowledge and agree that:

  • The Service is under active development and features may change without notice;
  • Data you upload or generate may be modified, lost, or deleted;
  • Features may not function as expected, and downtime may occur.

We welcome feedback and bug reports to help improve the platform.
